Criminal Tax and Antitrust Matters

Dave Stetler served with the Criminal Tax Division of the Office of Chief Counsel for the IRS. Joe Duffy, a CPA, served as an Agent for the IRS. SDR draws on their experience as it represents clients in nationally significant criminal tax prosecutions. In addition, Stetler, Duffy & Rotert, Ltd. attorneys frequently represent individual corporate employees of companies involved in antitrust investigations conducted by the Federal Trade Commission, the Department of Justice, or other government regulators.

REPRESENTATIVE CASES

SDR represented a lawyer charged with income tax evasion and a “Klein” conspiracy in one of history’s largest criminal prosecutions involving professionals in the tax-shelter industry. SDR lawyers defended our client during a three-month jury trial in the Southern District of New York. The investigation and trial of this matter involved defendants employed at America’s most prominent law firms, accounting firms and financial institutions. The case, United States v. Paul Daugerdas, et al., currently is in post-trial litigation.

SDR lawyers represented a businessman from northern Indiana who was indicted on charges that he committed tax fraud and sought to defraud the IRS through his payment of millions of dollars to a captive off-shore insurance company. After a three-week jury trial in federal district court, our client was acquitted on all charges. United States v. Stamatakis.

SDR attorneys successfully defended an executive of a Midwestern dairy in a criminal bid-rigging case brought by the United States Department of Justice. The charges brought against our client were dismissed by the DOJ two weeks into the trial. United States v. Prairie Farms, et al.

SDR represented the former Vice-Chairman of the Archer-Daniels-Midland Company as part of a criminal price-fixing prosecution that garnered national publicity and was the basis for the film “The Informant.” United States v. Andreas, et al.

Our lawyers have represented numerous executives and employees of various corporations during criminal antitrust investigations. Working closely with corporate counsel, we have assisted executives and employees involved in a diverse array of industries, including construction, newsprint and fine paper products, oil and gas, water tower construction, hospitals and health care, microchip and electronics goods, plastics, and automobile tires.
